Advise needed on Ebay transaction GONE BAD

chilinvilin - 2008-09-03 17:34

Ok here is the link to said auction Click Here
Im a truck driver that is on the road 3 to 4 weeks at a time so doing anything is a pain in the azz. Anyhow paid for radio and was out on the road for 2 or 3 more weeks after payment. When I got home radio still hadnt arrived yet so went back out for 3 weeks and while I was out radio arrived. So got home on the 31st of last month and opened package for the 1st time on sept 1st before I started the bbq for family. So anyhow me and my brother started opening it and man was this thing packed well and I was feeling confident till when I got to the radio and heard something rattling around in it. AHHHHHHHHHHHHHHHH!!
Anyhow so I begin to inspect the radio which is in kinda lousy shape. I noticed on the side of radio the hole in which you put the ac cord into was just a hole and you could see inside the radio. The jack had broken off and fell inside radio.....
I decided right there this is going to be a parts box now and opened the radio up and sure enough jack had broken off and was banging around in radio. I also noticed a unsoldered piece of wire going to each speaker lead. It looks like the left channel of radio is out so they decided to do this to get both left and right channels to work. Man this sucks!
So I get ahold of seller in an email asking him to give me some history on radio before I post feedback on you and he replies that it was his own personel radio that was bought for him from a relative. If he would of said he got this at an estate sale or he doesnt know much about it cause he bought it to resale then I wasnt really gonna lean on him that hard.
I then write him back to tell him the problems I observed and he writes me back telling me the radio was fine and I must of broke the radio and I must have faked the pics and am trying to return a bad radio I purchased before that was allready broken.
I write him back and tell him I never had any plans on returning radio cause I could use it as a parts radio and I just wish you would of stated these problems in auction because this is a little expensive as a parts only box. To which he responded with some more sarcastic jibberish.
Anyhow I have all his emails as well as the pics....
So what would you do?
Here are the pics of the box Click Here

reli - 2008-09-03 17:38

Just give him a negative, sellers can't retaliate anymore.

fatdog - 2008-09-03 17:46

That long, black wire is definitely not from Prosonic. That's a hack job and a half. If the rest of the AC/DC plug housing is still around, it should be an easy fix.

Have you tried headphones to confirm that the left channel is out?

I agree with Reli - leave this guy a negative. He, or somebody he knew, has been inside this box and screwed up some stuff.

- 2008-09-03 17:50

Ask for you're money back and send the box back if he says no then neg him.

reli - 2008-09-03 17:57

Neg him anyway, other buyers deserve to know that he's a risk. Besides, why should everyone have 97-100% positive feedback?

That's a rather reckless thing to say! No No If a seller is a great seller, you can't give him a negative for no good reason at all!

I understand your main point tho...

jt - 2008-09-03 18:32

Maybe his relative did the hack job and he simply doesn't know better? If he's gonna tell you something like that, he's probably in the dark as well.

As much of a pain in the a$$ as it is, I'd tell him you want to send it back because you were overcharged. Maybe that way, he'll agree to give at least a partial refund and you'll end up with a cheaper parts box. Let him know that positive feedback is on the line. His tune might change.

Similar thing happened to me with my Walkman WM-D3 that was supposed to be perfect, but the seller was cool and just refunded half. I ended up fixing the issue and it works fine now, but it was nerve wracking and cost me several hours of my life...

chilinvilin - 2008-09-03 18:40

Thats the thing in his emails he is accusing me of just wanting to send him another radio other than the one he sent me. The thing is in none of the emails did I mention returning it that is something he has come up with on his own. He is basicaly saying he wouldnt want it back even if I wanted to return it cause I would just send back some other radio.
Thanks for all your help guys im still trying to make up my mind here...

oldskool69 - 2008-09-03 18:41

I agree with JT...BUT...

You said to him already that you were willing to keep the box so a refund may be unlikely but try anyway.

If the sarcasm continues, save the screenshots of the message string. Leave him a negative. He can't strike back but can protest with eBay at which time you may get asked by eBay to respond. If that happens you can send the page and then BAM, case closed.

At least it appears as an easy fix. And you also have a box that not everyone has that looks pretty good as well. Smile

He sure doesn't sound like a great seller to me.

You can also put a complaint into ebay and they may side with you to refund you some money as well.

I Agree

transamguy1977 - 2008-09-03 19:28

This sounds like the same looser I bought my m-90 from.
He started accusing me of wanting to send him back the radio with different parts in it.
In other words I buy a box , swap the parts for what i need then send the box back. Roll Eyes
Once I made it clear to him I wanted to keep the radio, I got him to give me a partial refund.
Which I was very happy with.
Thank goodness I payed with paypal as they went to bat for me as well.
They also froze his account until it was resolved.
Keep track and make all your communications through ebay so they have it on record.
Its a pain in the arse but if you stick with it you should get a refund.
Dont leave a neg first because he will be less likely to work with you.

Um.. I finally got home after being on the road for a month. First let me say thank you very much for the awesome packing job you did. That was packed better than the other radio I recieved a year ago which came busted up.
Ok on to your radio...
I slowly opened it up and was taking pics with my digital camera as I went along. Finaly got the radio out of packing and noticed something banging around inside radio. Oh no!!
So I grab the cord to plug it in on side of radio and to my surprise the jack on the radio had been broken and was inside radio. No way to test radio....
So being that Im collecting this brand im very very familiar with the insides of unit. I grabbed some tools and began the slow process of taking radio apart while taking pics.
First off there was screws missing because who ever had radio b4 has taken it apart and didnt bother to put all of them back in radio.
Anyway...
The power jack on side of radio was broken off of its bracket and just sitting inside radio cabinet. So that will have to be fixed and it looks like someone also modified the speakers to unit.
There is a wire that was not put on by the factory running from one speaker to the next. It looks like the left channel on radio is out so this little wire hack will get both speakers to work.
Also the radio has been opened up so many times that the cabinets have broken plastic and bent plastic from what looks like forcing the radio back together. Another words someone didnt know what the hell they were doing and shouldnt be inside a radio messing around.
Let me know if you want the pics sent to you...
I am undecided as to what action I want to take with ebay... I will probably just use this radio for parts for my other ones but I wish you would of been more forthcoming with the description? If I had known up front what the condition of this was I would not of bought it.
I paid way to much for it in this condition.

Thanks

First of all that is a bunch of BS...

The unit was working fine other then the Tape Deck. I know that there was no way that the power cord was broken off because I tested the unit before I listed it and the power cord jack was perfect. The tape deck issue was clearly indicated in the auction there were no other problems...Without the proper electrical schematics how do you know the wiring is wrong...Since you are not a technician how do I know that you did not break these parts well taking it apart? Even if this was a brand new item the warranty would be nil and void since the item has been tampered with...
This unit was checked over completely before selling by me. The unit is also my personal unit and it has never been opened by anyone. You had indicated that you bought one of these before. Are you trying to bait and switch your item for ours.

I sold electronics for many many years and I am full aware that unless you are qualified as a tech..Meaning you have your papers than you are not qualified to fix electronics.

Just a little recap on this transaction. First you bid on the item and than take 10 days to pay(which is acceptable). Then you send an accusing a-mail saying that we ripped you off. Now you are trying to say almost 2 months after the auction closed that the unit has all these problems...Sorry but Something just doesn't smell right here...The unit had to issues the tape deck did not play and a knob was missing both were indicated in the auction...There was nothing else wrong until you decided to open the unit...The proper procedure would have been to contact us with your issues not opening the unit and then it breaks and now it is our fault...As for the pictures you could be sending pictures of any unit since you collect them...Or you could just be sending the pictures of the unit after you broke it trying to open it...These units are very delicate and if you forget one screw and a little force and it breaks...

Regards
Tim

Oh yah it took me 2 months?
I go out for a month at a time over the road as a truck driver. I paid you the money via paypal and I think I was out for an additional 2 or three weeks before getting home. I got home and the radio had still not arrived so I went back out for another month and while I was out the radio finally arrived but I didnt get home for another 3 weeks which by the way was sunday the 31st. I opened up package on the first while my family was over for a bbq. Like I said you dont know me so dont draw conclusions and claim im frauding you!

Look the radio that was sent was exactly as described. As for saying that you are frauding me I never said that.,..You are the one that seems to constantly jump to conclusions...Starting with saying we ripped you off for your cash from the beginning. As for the pics they don't prove a thing..You could be opening anything on the pics...I never mentioned anything about fraud...Perhaps you are feeling a little guilty!!!

Ok you didn't say fraud you said bait and switch. Lets not get technical...
You know you sold me a piece of sh?t and that's something I will just have to let go. No use fighting it out over email.
And now your the one that seems like there guilty look how defensive you were after I told you about said problems. Who gives a sh?t about the tape player I never even brought that up.
Go ahead and get your laughs man you frauded me!!
How the hell could you not tell that the left channel of the radio was out? If you didn't know this and you say its your personal radio then your a bigger dumbaZZ than I thought.
Thats probably why you sold it cause its a pile of crap!
The only reason I asked you if you ripped me off was because after I paid you you didn't send me a tracking number. It took you a long time to... Thats why I sent you and email asking what's up and did you rip me?
What you don't think you had taken a long time to get back with me the tracking number? So what's the appropriate time to wait? You keep thinking all these things lead up to some big grand conspiracy but they don't. When you send someone that much money that you have never met before hell you get a little worried when no tracking number is sent to you for a long time!
I'm gonna sleep on it tonight and than get a hold of ebay and decide what kind of feedback im gonna give you. I am not deciding this right now because I know how these things work when the buyer leaves negative feedback than the dumbaZZ seller gets butt hurt and retaliates by leaving negative feedback on buyer.
I never asked for cash back I never asked to let me return it.... your the one drawing conclusions about that!!
At least man up and admit you were wrong!
If im dissatisfied about transaction than the feedback has to reflect that right?
How do your think I should leave your feedback?

Damn nice email chain Laugh Out Loud I guess you mailed to his private account instead of using Ebay's message system?

Every time I use Ebay's message system, it only saves one pair of question and response. It doesn't save the entire message chain. I wish their message system preserved everything in one message, so that you could easily forward it to Ebay in case of problems like this.

chilinvilin - 2008-09-03 20:23

He sure doesn't sound like a great seller to me.

Of course, he's not a great seller. But then again, I'm not talkin' about THAT seller. What you wrote in the sentence I quoted made it sound as if you were generalizing ALL sellers... which is the reason I added, "I understand your main point tho... " Wink

'Cause I hope you're not into the idea of people giving a seller - again, not THAT seller but ALL sellers - a negative because their score is perfect.

Both Channel worked fine. The only thing wrong with the radio was the tape deck. This was clearly mentioned in the listing. If the left channel would have been out it would have been mentioned in the listing. End of story
.
.
.
Ok so your standing by with that story.
Thats fine I have tried to resolve issue with you but you still see it that Im the one that messed up the radio.
Heading over to ebay right now .. you will get a negative and will be getting ahold of ebay to show them my evidence in the matter and am gonna get ahold of paypal cause they also dont take stuff like this lightly. What could of been resolved between me and you is now gonna be resolved by ebay and or paypal.
Whether you know it or not you sold me a radio that had issues outside of the ones you posted in item description.
Gave a great day!
.
.
.
You know since I didnt want to send radio back I was just hoping we could of resolved this with him sending me back some of my money. You know what in the beginning if he would of just played stupid and acted like he didnt know anything about the problems I probably would of just let this go and gave him a nuetral but look at what it has come to. This guy has been on the defensive from day one with all this.
So everyone knows he goes by the ebay name " holidayfunds" and he is from canada so just be cautious.
Thanks everyone for all there feedback on this matter!! Will let you all know the outcome of this but with me being out on the road so much I got a feeling its gonna take a very long time to resolve if it ever even gets resolved.
Thanks

No, what I'm saying is: It's too hard to find the good sellers if everyone has a feedback of 97-100%. If you had a negative experience, you should give negative feedback, period......as a warning to future buyers. People should only get positive if it was deserved. Just like good grades in school.

Ok dispute put in with paypal. And by the way thanks for the positive feedback with negative remarks. Not gonna help at all guy. I could care less im not in the business of selling like you.
As far as im concerned now ebay or paypal can resolve this but if you still wanna resolve this outside of them and want to lose your negative feedback then do whats right and admit you sold me something that was broke and wansnt described in auction as being that way.
You know that was the reason you didnt put additional photos of item up and explain the additional defects is because the radio would of brought you way less coin and you know that!
If you would of posted this radio the right way I could almost guaruntee it would not of sold for more than maybe $75 U.S.
There is one more step I can take with paypal by the 23rd of this month so you be the deciding factor if you want it to go that far.
Oh and by the way YOUR AND AZZHOLE! azzhole!
.
.
.
Ok both ebay and paypal are on the case.. Will keep posting as results come in.
Thanks again all!!

chilinvilin - 2008-09-04 13:38

Ok case is closed. He refunded me a partial amount to which im satisfied with but he still calls me a jerk and a liar in the feedback left. I am in the process of getting that removed thru ebay policy because if he makes a refund than to me thats admitting guilt. So I dont think he has a right to call me a jerk and liar after admitting he was wrong.
Oh well at least I got some of my money back and it didnt take very long to resolve I got to give him props for that. Maybe he just wanted me out of his life.... ahhahahahahahahahahahahaha

WOW!! I've never had an Ebay transaction go that bad! Eek Not even close...

My policy selling is that I will only sell items in the condition I would like to buy myself.

My policy buying is that even if the item is described as "mint," I will probably find something to fix. My standards are high...

I've only rarely been disappointed. Smile

chilinvilin - 2008-09-05 09:04

Just when you think this dude is done with he writes me another email telling me that he has forwarded my email to the authorities because I threatened him. I told him to F-off like 20 times. I couldnt take it anymore... I never once threatened him though just cursed him out.
There is good news though.. ebay removed his comments in my feedback.
They told me it was immature...hahhaahah
