nelsongf9696 - 2008-02-01 08:24

WELL WELL Here is E Bays reply.I don't think they care at all as long as they get there money. SCREW YOU.I reffered the pics question to them that the pics are from an earlier auction.Vlads auction of about a year ago and here is there reply.

Dear Nelson,

Thank you for writing eBay in regard to your report.

Under the terms of the eBay User Agreement, sellers are required to
include accurate information about any item that they offer for sale.
Posting false or misleading information is a violation of eBay policy.

Please understand, however, that as an online marketplace, eBay isn't
directly involved in transactions that take place between buyers and
sellers. We're simply not in a position to authenticate items.

Before bidding, we strongly encourage all bidders to ask the seller
questions about an item and request whatever documents or other
materials are necessary to prove the item's authenticity.

ford93 - 2008-02-01 08:26

They're not buyer friendly! Mad

nelsongf9696 - 2008-02-01 08:26

Of course I already knew they didn't care but.It still doesn't cease TO AMAZE how much they don't. Mad

masterblaster84 - 2008-02-01 08:42

Laugh Out Loud Laugh Out Loud

They could have sent you a shorter response that made the same point, how about the following.

Dear Nelson,

F.U.

Sincerely ebay

billpc55 - 2008-02-01 08:46

intresting how they just send out a form letter.
pathetic.

nelsongf9696 - 2008-02-01 10:23

Well Here is the second section of the letter.Note. What they say about the image....

If you purchased an item that you feel was misrepresented, we recommend
that you file an Item Not Received or Significantly Not As Described
dispute. The eBay Trust and Safety team will investigate your claim and
take appropriate action. Violations of eBay policies may result in a
range of actions, including listing cancellation, limits on account
privileges, account suspension, loss of eBay fees on canceled listings,
and loss of PowerSeller status.

Regarding you report on images copied from another listing, please
understand that in some situations members will allow others to use
their images. It's also possible that the members acquired the photo
from the same source or a source that we can't verify. If this is the
case, eBay can't remove the listings.

We will be able to take action only if the person who owns the image or
text writes to us directly. If you feel strongly about this issue, I
recommend that you contact the seller, informing him or her about your
concerns and recommending that he or she contact eBay. Once we hear from
the seller, we will then take the appropriate action.

nelsongf9696 - 2008-02-01 10:30

I contacted VLAD about his pics being used .We have to wait to see what he'll do. They claim he would have to make a complaint Himself.

themightyrepairer - 2008-02-01 11:24

i thought that background looked familiar.. sneaky indeed..

nelsongf9696 - 2008-02-01 11:44

I contacted vlad but e bay is being unreasonable they want him to provide Item number. Tha sale was almost a year ago and he does not have I looked through old post here since I knew it was commented about on this forum at the time but there was no link Frown. Although the link would show as item has ended it would of provided an item number .

Below is Vlad response to me
Dear noslensiulzelevsatner,

I can't do anything, because E-Bay asking for my listed item #. This auction finished long, long time ago & I don't have this #

I can understand the position Ebay takes with regard to this. They really don't have time to go around authenticating hundreds of millions of items for sale on their service each year. It is up to the bidder to do their research, and a big part of why having a site like this is such a great thing. We are pretty much the definitive resource for anyone looking to buy portable radios online.

What I would like to see is Ebay make a change to the listing policies such that any item that is sold with photos must either be of the actual item they are selling, else it must have accompanying language in the auction that the pictures are not of the actual item being sold.

skippy1969 - 2008-02-01 12:14

Looks like someone is going to get screwed and not even getting a kiss! Roll Eyes Mad

- 2008-02-01 13:46

What e-Bay needs to do is STOP newbie sellers from selling $800+ items for a first sale...it's a TOTAL joke IMO Wink

moncheeto - 2008-02-01 14:16

the guy may be using the pic to gain money or using it to sell a junked one and trying to say its good. i thought i have seen this same post not to long ago with this same radio and someone else trying to sell but not vladi... Confused

panasonic.fan - 2008-02-01 14:23

Perhaps Vlad should start watermarking his pictures in a way that prevents others from reusing them in auctions so easily.

VLAD you really should watermark your pics as PanFan has adviced here.

zvlad - 2008-02-05 05:28

I just got next message from E-Bay:

"Thank you for writing eBay in regard to the unauthorized use of image and text. We've reviewed your listing and the listing that you reported. The listing that you reported doesn't appear to be substantially similar to yours. We haven't found a violation of eBay's Item Description and Picture Theft policy. I recommend that you check the listing again to see if it has been revised since you last checked. It's possible that the member has already removed the material that you reported. If you still feel that the listing is substantially similar to yours, please reply to this email with specific examples that show how the member copied your material."

I don't know if this seller has this boombox & just used m y pictures, but anyway he use my pictures (and description as well)without my permission. Because seller has ZERO feedback rating beware and if you win this auction use paypal like payment option only. Without doubts paypal is good service for buyers.

to be honest I don't care if somebody use my pictures... many people do that. Just when you buy something, specially something expensive check everything carefully first before making decision

ford93 - 2008-02-05 05:39

Glad to see you have taken action on this situation Zvlad, this could have put you in a real mess with members here!

Ebay should take care of this asap too many have complained to them it should be proof enough! Mad
